General Terms of Service for BigfootDS

1. About these terms

These terms apply when you use BigfootDS websites, games, software, integrations, and other services we make available (the Services). If a particular Service has its own terms, licence, or store listing terms, those additional terms apply to that Service and take priority where they conflict with these general terms.

2. Accepting these terms

By accessing or using the Services, you agree to these terms. If you do not agree, please do not use the relevant Service. If you use a Service for an organisation, you confirm that you have authority to agree to these terms on its behalf.

3. Using the Services

Please use the Services lawfully, respectfully, and only for their intended purpose. You must not interfere with the security, operation, or access of a Service; attempt to gain unauthorised access; distribute malware or harmful content; impersonate another person; infringe another person's rights; or use a Service to harass, abuse, or deceive others.

Some Services may connect with third-party platforms, such as Discord or Steam. Your use of those platforms is also governed by their own terms, policies, and account rules. BigfootDS is not responsible for third-party platforms, their availability, or changes they make to their services.

Unless we state otherwise, BigfootDS and its licensors own the intellectual property rights in the Services and their content. We give you a limited, personal, non-transferable right to use the Services as intended. This does not give you ownership of the Services or permission to copy, sell, distribute, modify, or exploit their content beyond what applicable law or a separate licence allows.

If a Service lets you submit feedback, ideas, or other content, you keep any rights you have in that material. You give BigfootDS a non-exclusive, worldwide, royalty-free licence to use it only as needed to operate, improve, or promote the relevant Service. Do not submit material that you do not have the right to share.

6. Availability and updates

We may update, change, suspend, or retire a Service where reasonably needed, including for maintenance, security, legal, or product reasons. We will try to give notice where it is practical to do so, but cannot guarantee that every Service will always be available or free from errors.

7. Purchases and consumer rights

Where a Service is purchased through a store or platform, that store's purchase and refund processes may also apply. Nothing in these terms excludes or limits rights that cannot be excluded under applicable law. For Australian consumers, this includes consumer guarantees under the Australian Consumer Law. Our handling of personal information is described in our General Privacy Policy. Third-party platforms handle information under their own privacy policies.

9. Suspension or termination

We may suspend or end access to a Service if we reasonably believe these terms have been breached, if this is needed to protect people or the Service, or if we stop offering the Service. You may stop using the Services at any time.

We may update these terms from time to time. We will post the revised terms on this page and update the date above. Continuing to use a Service after the updated terms take effect means you accept the revised terms, to the extent permitted by law.
